Terms of Service

1. Products and Services

We offer the following products and services through our website https://executioncompass.co:

• —The Execution Compass app: a subscription to the AI assistant, boards, voice, and automations (monthly recurring, billed via Stripe).

These products are primarily targeted at individual (B2C) customers, but may also be purchased by business clients.

2. Payments

All payments are processed securely via Stripe.

• —Subscriptions renew automatically each month unless canceled before the next billing cycle.
• —You authorize us to charge your selected payment method for recurring or one-time payments, depending on the product purchased.

3. Refund Policy

• — App Subscriptions: Because the AI assistant relies on paid third-party services, any credits you use represent real costs we have already incurred on your behalf. For this reason, we do not refund a billing period in which any credits have been used. If you have not used any credits in the current billing period, you may request a refund, which we review individually and grant at our discretion.

4. Right of Withdrawal for Digital Products

By purchasing digital content (app subscriptions), you acknowledge and agree that delivery of the digital product begins immediately after purchase. As a result, you expressly waive your right to withdraw from the contract under Article 38 of the Polish Consumer Rights Act (implementation of EU Directive 2011/83/EU).

This means that once the product is delivered or the service begins, you are no longer entitled to a 14-day withdrawal period, unless otherwise specified in our refund policy.

5. VAT & Invoicing

• —We comply with Polish and EU VAT regulations.
• —VAT, if applicable, is included in the price or calculated at checkout based on your location.
• —Business clients may provide tax IDs at checkout.
• —Invoices are available upon request.

6. Use of Products and Services

You agree to use our products and services only for lawful purposes.

• —Reselling, redistributing, sublicensing, or sharing purchased digital products is strictly prohibited without written permission.
• —You may not use the services in any way that interferes with or disrupts our operations or infringes on intellectual property rights.

7. Credits

The AI features of the app are powered by credits. Credits are a unit we use to meter use of the AI assistant (chat, voice, guided routines, and automations). Credits have no cash value, cannot be exchanged for money, and are not transferable. Each paid plan includes a monthly allowance of credits that resets at the start of each billing period; unused credits do not roll over. When your credits for a period are used up, AI features pause until your credits renew or you upgrade your plan, while your boards and data remain accessible. We may adjust credit allowances and what actions consume credits, with reasonable notice for material changes.

8. AI Assistant and No Professional Advice

The app includes an AI assistant. AI-generated output may be inaccurate, incomplete, or outdated, and should not be relied on as a sole source of truth. The assistant does not provide professional advice. Nothing it produces constitutes legal, financial, tax, medical, or other professional advice, and you should consult a qualified professional before making decisions in those areas. You are responsible for reviewing AI output before acting on it. To provide the assistant, your inputs are processed by third-party AI providers as described in our Privacy Policy.

9. Service Availability

We aim to keep the service available and reliable, but we do not guarantee uninterrupted, error-free, or always-available access. The service may be unavailable due to maintenance, updates, third-party outages, or factors beyond our control. We may modify, suspend, or discontinue features at any time.

10. Disclaimer of Warranties

To the maximum extent permitted by law, the service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will meet your requirements, be error-free, or that defects will be corrected. This does not exclude or limit any rights you have as a consumer that cannot be excluded under applicable mandatory law, including Polish and EU consumer law.

11. Limitation of Liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from or related to your use of the service. Our total liability for any claim relating to the service is limited to the amount you paid us for the service in the twelve months before the event giving rise to the claim. Nothing in these Terms excludes or limits our liability where it cannot be excluded or limited under applicable mandatory law, including liability for death or personal injury caused by negligence, for fraud, or for your statutory rights as a consumer.

12. Account Suspension and Termination

You may stop using the service and cancel your subscription at any time from your account. We may suspend or terminate your access if you breach these Terms, use the service unlawfully, or where necessary to protect the service, other users, or our rights, and we will give notice where reasonably possible. On termination, your right to use the service ends. Provisions that by their nature should survive, such as payment obligations, disclaimers, and limitation of liability, continue to apply.

13. Changes to These Terms

We may modify these Terms at any time. Updated terms will be posted on our website and apply immediately to new purchases. Continued use of our products or services after changes indicates your acceptance of the revised Terms.
